Partydip LLC Privacy Policy

We at Partydip LLC have created this privacy policy (“Privacy Policy”) because we take privacy of personal information seriously and we know that our Users care about how information about them and their families is used and shared. This Privacy Policy applies to all Users of https://partydip.co and Partydip ("Partydip") websites, services, applications and products that collect data and display these terms (collectively, our "Sites").

Definitions

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Terms of Use.

“User” means any person who visits our site by logging onto https://partydip.co.

Information we collect

Partydip collects many types of information in order to operate effectively and provide our Users with the best products, services and experiences. This information includes:

  • Information User provides (for example, when User registers with our sites by creating an account, creating a wish list or registry on our site, signing up for our newsletters or email lists, participates in surveys, sends an inquiry to a Vendor, or purchases a Supplier’s product);
  • Information collected automatically (for example, we may use cookies, web beacons and similar technologies that collect non-personal information about User’s use of our sites, interactions with our emails, and information about User’s computer and web browser);
  • Information collected from other sources (for example, we may collect information from commercially available sources such as data aggregators and public databases or information from our Vendors).
  • We may also combine this information to help us tailor our communications and advertisements to User, develop exceptional products and services, and improve our sites.
  • We also use third party ad networks and similar providers to serve advertisements on our sites. These providers may use cookies and similar technologies to collect non-personal information such as User’s IP address. They may also use anonymous data received from third parties to assist them in delivering more meaningful advertisements to our Users.
  • At our sites, we collect information from User when User chooses to share it with us to use our sites or services, register with our sites, sign up for newsletters or our e-mail list, sign up to receive text message alerts, participate in an online or text message survey or promotion, purchase products or services from us, or otherwise contact us. The information we collect may include User’s name, address, telephone number, mobile telephone number, e-mail address, age, gender, photo/image and, if User makes a purchase on our sites, credit/debit card number or other financial information. User may also be required to provide certain information to create an online account. While some information is mandatory to create an account, User can control what information is available to other members on our sites. We do not require User to register or provide this information to us in order to view our sites or have access to most site content.

Information we collect automatically

We may use cookies, web beacons, pixel tags, log files, or other technologies to collect certain information about Users of our sites to deliver online advertisements that we think would be more relevant to User’s interests, and to monitor interactions with our emails, text messages and online advertisements. For example, we may automatically collect certain non-personal information from User, such as the type of web browser and operating system User uses, the name of User’s Internet Service Provider, Internet Protocol ("IP") address, software version, course geo-location information (for example, based on IP address or location of cellular tower used for the connection), and the domain name from which User accessed our sites. In addition, we may collect information about User’s browsing behavior, such as the date and time User visited our sites, the areas or pages of our sites that User visited, the amount of time User spent viewing or using our sites, the number of times User returned to our sites, other click-stream or site usage data, emails or ads that User open, forward or click-through to our sites. Collecting this information, and linking it with User’s personally-identifiable information, helps us best tailor our sites and enhance User’s online experience by saving User’s preferences while User is visiting our sites, and to help us identify sites features, advertisements, and offers that may be of particular interest to each User.

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. Combined Information

We may combine the information we receive from and about User, including personal and non-personal information collected through our sites, to help us tailor our communications to each User and to improve our sites, services, and products.

Information collected from other sources

We may obtain information about User from other sources, including commercially available sources, such as data aggregators and public databases. This information may include name, demographic information, interests, and publicly-observed data, such as from social media and shopping behavior.

User’s ability to control cookies and similar technologies

Cookies, web beacons, Flash cookies and similar technologies serve many important functions that help us serve User better. However, User has a variety of tools to control cookies and similar technologies, including web browser controls to block and delete cookies, or adjust User’s tracking preferences;

User can set his or her Internet browser or operating system settings to stop accepting new cookies, to receive notice when User receives a new cookie, to disable existing cookies, to omit images (which will disable pixel tags) or adjust User’s tracking preferences. Note that the opt-out will apply only to the browser that User is using when User elects to opt out of advertising cookies. User can opt out from receiving third party advertiser cookies by visiting the Digital Advertising Alliance's opt-out page. Without cookies or pixel tags though, User may not be able to take full advantage of our sites' features. User may check "Tools" or "Help" tab on User’s browser to learn how to change User’s cookie and other tracking preferences

How we use User’s personal information

Partydip uses the information we collect for many important purposes, including to:

  • Provide the products and services User requests;
  • Communicate with User regarding our products and services, as well as those of our partners and affiliates;
  • Share or post reviews of our products and services; and
  • Display more meaningful and relevant advertisements.

Partydip may use the information we collect from and about User for any of the following purposes:

  • To respond to User questions or comments, fulfill orders, process payments and prevent transactional fraud, provide services, and contact and communicate with User;
  • To provide User with customized sites content, targeted offers, and advertising on our sites, on other sites, or via email;
  • To contact User with information, newsletters, and promotional materials from Partydip.
  • To post review of products and services on our sites;
  • To develop new products or services;
  • To address problems and review the usage and operations of our sites or business and improve our content, products, and services;
  • To manage our telecommunications networks;
  • To protect the security or integrity of our sites and our business; and
  • As described to User at the point of data collection.

How we share User’s personal information

Partydip does not sell or disclose User’s personal information to unaffiliated third parties without User’s consent, except where:

  • We engage third-party service providers to assist us with the activities identified in this privacy statement. In these situations, we only allow these providers to use User’s personal information as necessary to perform activities on our behalf or to comply with a legal requirement;
  • It is necessary to prevent crime or injury, or as otherwise required by law; and
  • Another company acquires us or any of our assets,

Partydip shares User’s personal information with the following Partydip partners:

  • Suppliers will receive User’s full name, email, and the shipping address for User’s order placed on the Partydip website for the Supplier’s products. As a partner of Partydip, Suppliers are allowed to market their products and services to User’s email address. Suppliers are not allowed to sell or share your personal information.
  • Vendors will receive User’s full name and email address upon receipt of User’s inquiry about the Vendor’s party goods and services. Vendors are allowed to utilize the User’s email address to reply to the User’s inquiry and market their products and services.

We do not sell or otherwise disclose personally identifiable information about our sites' Users, except as described here. We do not share User’s personally identifiable information with unaffiliated third parties for their own marketing purposes.

How we protect User’s information

We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information User supplies will not be intercepted while being transmitted over the Internet. In particular, email sent to us may not be secure, and User should therefore take special care in deciding what information User sends to us via email.

Choice & control over User’s personal information

To change how Partydip contacts User, to correct or change User’s information or to cancel User’s registration with us, User can either update User’s information on our website or contact us. User is ultimately in control of the personal information provided to us on our sites. User can cancel User’s registration and we will take steps to remove User’s personal information from our database.

Children Under 18

We do not knowingly collect Personal Information from children under the age of 18 through our Sites without permission of the parent or legal guardian. We ask that Users under the age of 18 do not give us any Personal Information. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information without their permission. If there is reason to believe that a child under the age of 18 has provided Personal Information to us without parental consent, please contact us with proper identification, and we will endeavor to delete that information from our databases. Partydip and its Vendors do not sell products for purchase by children.

Links to other sites

Our Sites may contain links to third-party websites. Partydip has no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. User should check the applicable third-party privacy policy and terms of use when visiting any other websites.

Important Notice to Non-U.S. Residents

The sites are operated in the United States. If User is located outside of the United States, please be aware that any information User provides to us will be transferred to the United States. By visiting the Website and/or accessing and/or using the Platform and/or the Services and/or providing us with any information, User consents to this transfer. As our site and platform only operates in the United States, GDRP (General Data Protection Regulation) and other foreign privacy policies are not complied with including the capturing and usage of cookies and other web tracking products.

Public Forum Information

User may use our sites to post reviews of our products and services, but once User posts a review, it becomes public information and we may continue to display User’s review as content even if User’s account is terminated.

Any information, such as reviews, that User may disclose to User’s network of connections on our sites, in blogs, on message boards, in chat rooms, or on other public areas on our sites, becomes public information. Please exercise caution when disclosing personal information in these public areas. If User terminates User’s account, we may continue to show some of User’s content in anonymized form.

Notice to California Residents

Pursuant to California Civil Code 1798.115

Effective January 1, 2020, the California Consumer Privacy Act (“CCPA”) grants California residents various rights regarding their personal information relating to that resident or household that is held or collected by a business.

The User’s CCPA Rights

CCPA provides California residents with rights regarding their personal information collected by businesses. If User is a California resident, User may exercise the following rights regarding User’s personal information:

  • Right to Know. User may request an overview, in a commonly used format, of the personal information we collected in the last 12 months. User may also request additional details about our data collection practices, including the categories of personal information we may share for a business or commercial purpose, and the categories of third parties with whom we may share such personal information.
  • Right to Delete. User may request deletion of the personal information for any reason or ask to restrict the collecting of the personal information. However, we may retain certain information as required or permitted by applicable law.

Personal Information

When User creates an account or a wish list registry, User will be required to provide us information about User. The CCPA defines "personal information" broadly to include "information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household." Generally, to create an account or wish list registry on our Sites, User provide us with User’s first name, last name, home address, and email address. User may also provide us with User’s birthdate, phone number, names of User’s child(ren) or minors in User’s legal guardianship, and birthdates of User or minors in User’s legal guardianship. We may also collect or receive additional information (collectively, "Personal Information"). Sources of Personal Information

We collect personal information directly from User, including when User registers for an account, subscribes for newsletters and updates, purchases products, or signs up for and participates in any contests, sweepstakes, or promotions we provide.

Business Use and Purpose of Personal Information

We collect User’s personal information for business and commercial purposes, including to provide and improve our services, complete the transactions User requests, create and manage User’s account, and respond to User’s requests and other customer service communications.

Submitting Requests

Account holders and Users of https://partydip.co have the undeniable right to ask about and obtain a complete and accurate report on any personal information stored about them. Additionally, User may submit a request to delete the personal information we have collected. Please note that User may also designate an agent to exercise these rights on User’s behalf by providing written materials demonstrating that User has granted the authorized agent power of attorney. If User chooses to designate an agent, we may need to contact User to verify User’s identity for security purposes. We will not discriminate against User if User chooses to exercise User’s rights under the CCPA.

To exercise User’s rights, User may submit a request to us by sending an email to Partydip customer service indicating the request and specifying whether the purpose of such request is to know what personal information we have or to delete such personal information. User must include User’s first name, last name, and email address and specify the type of request desired. We cannot start the response procedure if we do not have all of this information. Upon submission of the email, User will receive a receipt of notice that will prompt User to verify User’s email. To protect User’s privacy, we are required by law to first verify User’s identity prior to granting access to User’s data.

CCPA defined Sale of Personal Information

California residents may opt out of what California has defined as a “sale” of their personal information at any time. If User would like to opt out of the use of User’s information for such purposes that are considered a “sale” under California law, User may do so using the process described under the “Submitting Requests” provision above. However, we do employ some third-party services, such as our email service provider, and some personal information may be securely transmitted to their website as necessary to provide our services. In addition, our website contains links to third-party websites that are not owned, controlled, or operated by Partydip. If User follows a link to any of these sites, please note that they have their own privacy policies and that Partydip does not accept any responsibility or liability for these policies. Upon visiting third-party sites, please review these policies before disclosing any personal information.

California “Shine the Light” Law

Under California Civil Code Section 1798.83, California residents who have an established business relationship with Partydip may choose to opt out of our sharing User’s Personal Information with third parties for direct marketing purposes by unsubscribing to our email list. User may unsubscribe by clicking the "unsubscribe" link located in the footer of an email from us. If User is a California resident and (1) wishes to opt out; or (2) wishes to request certain information regarding our disclosure of User’s Personal Information to third parties for direct marketing purposes, please email our customer care team.

In addition, Partydip does not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

Option to Password-Protect the User’s Wish List

If User creates a wish list registry with us, User consents to us posting the names of the registrant and the names of family members or those under the registrant’s legal guardianship that User provided on our website. If User wishes to limit access to this information, User has the option to password-protect User’s wish list registry so that only individuals with the password will be able to view the wish list registry. User can elect the option to password protect User’s wish list registry during setup or modify it at anytime by clicking “Manage my Wish List”.

Updates on our Privacy Statement

We may change or update portions of this privacy statement at any time and without prior notice to User. We request that User checks back from time to time so User is aware of any changes or updates to our Privacy Policy.
